Inheritance planning: almost 200 clients trust AMAT to plan their estate

Almost 200 clients have attended the two events organised by AMAT during the second half of October to discuss “Everything you need to know about inheritance”. The sessions, held on 14 and 28 October, provided an opportunity to explore family estate planning in greater depth, learn about different legal options and address questions about the tax implications of decisions affecting an inheritance.

Planning an inheritance involves much more than deciding who will receive the assets. Understanding the available options, the potential consequences of each decision and when to seek specialist advice can make a significant difference to how an estate is managed and passed on.

Three key legal arrangements for inheritance planning

During the events, three legal arrangements relevant to family estate planning were highlighted: loans between family members, inter vivos gifts and mortis causa gifts.

To explore these concepts in greater depth, AMAT provides resources and specialist information to help readers understand the differences between the various options and assess which may be most suitable for their circumstances.

Private loans and inter vivos gifts

When providing financial assistance to a child or another family member, it is important to distinguish between granting a loan and making a gift. Although both options allow money to be transferred, their legal and tax implications differ.

Maribel Cordón, lawyer responsible for AMAT’s Legal Services, explores these differences in the article Differences between private loans and inter vivos gifts.

Gifts of money and gifts of property

Not all gifts have the same consequences. Giving money and transferring a property are different transactions from a tax perspective, and it is important to understand their specific implications before making a decision.

In this article, Maribel Cordón analyses the main differences between the two options: Differences between inter vivos gifts: gifts of money and gifts of property.

Updates on mortis causa gifts

One of the key topics covered during the sessions was the new possibilities available through gifts made in contemplation of death in Catalonia.

José Vicente Galdón, notary in Esplugues de Llobregat, explained the main developments concerning this legal arrangement in detail, outlining the possibilities it offers and providing valuable information for those wishing to plan the transfer of their estate.
