{"id":4232,"date":"2019-01-23T12:35:19","date_gmt":"2019-01-23T12:35:19","guid":{"rendered":"https:\/\/amat-inmo-wp.localhost\/2019\/01\/23\/la-llei-darrendaments-urbans-lau-no-ha-nascut\/"},"modified":"2023-04-24T10:03:42","modified_gmt":"2023-04-24T10:03:42","slug":"la-llei-darrendaments-urbans-lau-no-ha-nascut","status":"publish","type":"post","link":"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2019\/01\/la-llei-darrendaments-urbans-lau-no-ha-nascut\/","title":{"rendered":"La Llei d&#8217;Arrendaments Urbans (LAU) que no ha nascut"},"content":{"rendered":"<h3 style=\"text-align: justify;\"><strong>L\u2019HABITATGE NO \u00c9S UNA MONEDA DE CANVI, \u00c9S UNA NECESSITAT QUE RECLAMA A CRITS CONSENS<\/strong><\/h3>\n<p style=\"text-align: justify;\">Despr\u00e9s de la derogaci\u00f3 del Decret Llei m\u00e9s curt de la hist\u00f2ria, que modificava la <strong>Llei d\u2019Arrendaments Urbans (LAU)<\/strong>, volem compartir amb tots vosaltres la nostra visi\u00f3 del mercat de lloguer.<\/p>\n<p style=\"text-align: justify;\">Com molts cops ens heu sentit dir, nosaltres que portem 70 anys en el sector immobiliari, sempre hem estat oberts a treballar per fer compatible tot tipus d\u2019ofertes com la compravenda, el lloguer, les cooperatives,&#8230; i qualsevol nou plantejament que la societat actual pugui imaginar, sempre tenint clar que sortim d\u2019un d\u00e8ficit hist\u00f2ric de lloguer i que s\u2019ha de resoldre amb la velocitat m\u00e9s alta possible. La societat actual \u00e9s una societat l\u00edquida i aix\u00f2 vol dir que el pagament per \u00fas ser\u00e0 un dels mitjans que m\u00e9s afavoreixin aquesta din\u00e0mica de la societat del segle XXI.<\/p>\n<blockquote>\n<h3 style=\"text-align: right;\"><strong>El lloguer no \u00e9s altre cosa que un pagament per \u00fas<\/strong><\/h3>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong>Potenciar doncs el lloguer \u00e9s la missi\u00f3 i el deure de tots els governants<\/strong>, i ho han de fer per dos camins. El primer \u00e9s fent oferta d\u2019habitatge protegit per fam\u00edlies en risc d\u2019exclusi\u00f3 social; el segon \u00e9s fomentar que la inversi\u00f3 privada desenvolupi part de l\u2019oferta necess\u00e0ria per cobrir una demanda que avui no pot trobar sortida i que pressiona els preus a l\u2019al\u00e7a.<\/p>\n<p style=\"text-align: justify;\">I, tot aix\u00f2, es pot fer respectant absolutament al llogater tant si les regles del joc s\u00f3n clares o si tenim una <strong>Llei d&#8217;Arrendaments Urbans<\/strong> moderna, clara i amb garanties per les dues parts.<\/p>\n<p style=\"text-align: justify;\">No vam estar d\u2019acord en absolut amb la Llei 4\/21013 que desprotegia totalment al llogater i que cap propietari havia demanat, ni amb el Decret Llei de 18 de Desembre de 2018 que ahir van derogar, malgrat considerar que hi havia punts positius com allargar el contracte. <strong>Estem parlant de temes molt sensibles<\/strong> (la vida de les fam\u00edlies, l\u2019entorn on s\u2019educaran els fills,&#8230;) en qu\u00e8 l\u2019estabilitat afavoreix les dues parts. En definitiva, el Decret era clarament conf\u00f3s i fruit de la precipitaci\u00f3 i tampoc resolia la complexitat del m\u00f3n del lloguer.<\/p>\n<p style=\"text-align: justify;\">Ara, toca negociar una nova modificaci\u00f3 de la Llei d\u2019Arrendaments. <strong>Demanem a tots els actors pol\u00edtics que fugin de mesures buides i populistes<\/strong>, que aprofitin l\u2019oportunitat per fer una reflexi\u00f3 en profunditat sobre cap a on ha d\u2019anar la societat i serveixi per trobar un equilibri entre els interessos de les parts, no per imposar mesures no objectives que acabin frustrant les possibilitats d\u2019inversi\u00f3 privada, absolutament imprescindible per, entre tots, poder <strong>arribar a nivells d\u2019oferta de lloguer dels pa\u00efsos europeus<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Es fa un \u00fas i ab\u00fas quan es parla de posar topalls a les rendes sense especificar qu\u00e8 vol dir i, sobretot, quins seran els instruments per porta-ho a terme. Volem deixar clar que <strong>estem absolutament en contra de proposar topalls<\/strong>, distorsionant aix\u00ed els valors raonables de mercat.<\/p>\n<p style=\"text-align: justify;\">El passat 2017, la Generalitat de Catalunya va posar en marxa un altre sistema, molt m\u00e9s avan\u00e7at i transparent, l\u2019anomenat <a href=\"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2017\/10\/la-manca-doferta-marca-la-tendencia-del-mercat-lloguer\/\"><strong>\u201c\u00cdndex de Refer\u00e8ncia de preus de Lloguer\u201d<\/strong><\/a> que no \u00e9s una altra cosa que posar al servei de propietaris i llogaters les dades recollides i processades en base a les fiances dipositades. Es tracta, per tant, de dades absolutament reals i objectives i que donen com a resultat una franja de preus, zona a zona i tipologia per tipologia.<\/p>\n<p style=\"text-align: justify;\">El que hem de fer entre tots \u00e9s <strong>crear l\u2019h\u00e0bit de consultar aquestes eines<\/strong> que faciliten que no hi hagi abusos ni distorsions de preus, doncs quedarien absolutament en evid\u00e8ncia.<\/p>\n<p style=\"text-align: justify;\">El problema de la resta d\u2019Espanya \u00e9s que a pocs llocs es disposa de les dades objectives perqu\u00e8 l\u2019\u00cdndex pugui funcionar correctament, ja que no existeix el requisit de dipositar les fiances. \u00c9s per aix\u00f2 que, a cegues i de forma totalment arbitraria, es pret\u00e9n parlar de topalls quan el que <strong>s\u2019hauria que fer \u00e9s treballar la transpar\u00e8ncia i la informaci\u00f3<\/strong> que s\u00f3n la millor base de protecci\u00f3 de les parts.<\/p>\n<p style=\"text-align: justify;\"><strong>Fomentar el lloguer \u00e9s l\u2019objectiu i per fer-ho hem de conciliar propietaris i llogaters i \u00e9s responsabilitat de tots que aix\u00ed sigui.<\/strong><\/p>\n<p style=\"text-align: right;\"><strong>Joana Amat<\/strong><\/p>\n<p style=\"text-align: right;\"><strong>Vicepresidenta d&#8217;Amat Immobiliaris<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019HABITATGE NO \u00c9S UNA MONEDA DE CANVI, \u00c9S UNA NECESSITAT QUE RECLAMA A CRITS CONSENS Despr\u00e9s de la derogaci\u00f3 del Decret Llei m\u00e9s curt de la hist\u00f2ria, que modificava la Llei d\u2019Arrendaments Urbans (LAU), volem compartir amb tots vosaltres la nostra visi\u00f3 del mercat de lloguer.
