{"id":4174,"date":"2019-01-02T10:32:02","date_gmt":"2019-01-02T10:32:02","guid":{"rendered":"https:\/\/amat-inmo-wp.localhost\/2019\/01\/02\/canvis-importants-lau\/"},"modified":"2023-04-27T14:24:39","modified_gmt":"2023-04-27T14:24:39","slug":"canvis-importants-lau","status":"publish","type":"post","link":"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2019\/01\/canvis-importants-lau\/","title":{"rendered":"Canvis importants en la LAU &#8211; Llei Arredaments Urbans"},"content":{"rendered":"<p>AQUEST ARTICLE VA SER PUBLICAT ABANS DE LA NO APROVACI\u00d3 DEL DECRET LLEI PEL CONGR\u00c9S. <strong><a href=\"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2019\/01\/la-llei-darrendaments-urbans-lau-no-ha-nascut\/\">AQU\u00cd<\/a><\/strong> PODEU LLEGIR-NE M\u00c9S<\/p>\n<hr \/>\n<p>El passat\u00a018 de desembre, s&#8217;ha publicat al <strong><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2018-17293\">BOE el Reial decret llei 21\/2018<\/a><\/strong>, de 14 de desembre de mesures urgents en mat\u00e8ria d&#8217;habitatge i lloguer, que incorpora modificacions molt importants en mat\u00e8ria d&#8217;arrendament d&#8217;habitatge (l&#8217;arrendament per a \u00fas diferent del d&#8217;habitatge no ha patit modificacions) a la LAU.<\/p>\n<p>Aquest Reial Decret Llei ha entrat en vigor al dia seg\u00fcent de la seva publicaci\u00f3 i no t\u00e9 efectes retroactius, de manera que no ser\u00e0 d\u2019aplicaci\u00f3 als contractes d\u2019arrendament signats amb anterioritat a aquesta data.<\/p>\n<p>Les modificacions m\u00e9s significatives s\u00f3n:<\/p>\n<ul>\n<li>Es torna al principi de <strong>llibertat de pacte<\/strong> en arrendaments d&#8217;habitatge de superf\u00edcie superior a 300 m2 o de renda inicial superior a 5\u20194 vegades el salari m\u00ednim interprofessional.<\/li>\n<li>Queden definitivament exclosos de la LAU (Llei Arrendaments Urbans) els arrendaments tur\u00edstics o d\u2019\u00fas tur\u00edstic, en tots els sup\u00f2sits.<br \/>\nS\u2019amplia la <strong>durada m\u00ednima obligat\u00f2ria<\/strong> dels contractes, a 5 anys si el propietari \u00e9s persona f\u00edsica i a 7 anys si \u00e9s persona jur\u00eddica.<\/li>\n<li>S\u2019amplia la <strong>durada de la pr\u00f2rroga<\/strong> legal a 3 anys.<\/li>\n<li>S\u2019estableix que en els contractes de renda redu\u00efda (son aquells on la renda de lloguer est\u00e0 per sota de l\u2019establert pel conjunt de l\u2019estat), l\u2019actualitzaci\u00f3 es far\u00e0 aplicant IPC mentre duri el termini obligatori de durada, \u00e9s a dir 5 o 7 anys respectivament.<\/li>\n<li>Les <strong>despeses<\/strong> de gesti\u00f3 immobili\u00e0ria i formalitzaci\u00f3 de contracte aniran <strong>a c\u00e0rrec de l\u2019arrendador<\/strong> quan aquest sigui persona jur\u00eddica, excepte aquells serveis que hagin estat contractats per iniciativa directa de l\u2019arrendatari.<\/li>\n<li>Es posa un <strong>topall m\u00e0xim de 2 mensualitats a les garanties<\/strong> addicionals complement\u00e0ries a les fiances. Si el contracte t\u00e9 una durada superior a 5 o 7 anys respectivament, es podran ampliar aquestes garanties.<\/li>\n<li>S\u2019aprova una<strong> exempci\u00f3 del pagament de l\u2019ITP<\/strong> als llogaters; no obstant els propietaris hauran de continuar presentant en temps i forma el model 600 davant els Organismes competents. Aquesta presentaci\u00f3 tindr\u00e0 \u00fanicament un caire informatiu a tots els efectes.<\/li>\n<li>Es modifica la <strong>regulaci\u00f3 processal en la tramitaci\u00f3 dels desnonaments<\/strong>. Els serveis socials intervindran en el procediment a petici\u00f3 del demandat, en el cas de qu\u00e8 hi hagi situaci\u00f3 de vulnerabilitat, i aleshores l\u2019\u00d2rgan judicial suspendr\u00e0 el procediment (1 mes si el propietari \u00e9s persona f\u00edsica o 2 mesos si \u00e9s persona jur\u00eddica) fins que s\u2019adoptin les mesures que els serveis socials considerin oportunes. Transcorregut el termini i\/o adoptades les mesures el procediment continuar\u00e0 la seva tramitaci\u00f3.<\/li>\n<li>S&#8217;introdueix un nou dret de retracte en favor de l&#8217;administraci\u00f3 en determinats sup\u00f2sits de venda conjunta.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>AQUEST ARTICLE VA SER PUBLICAT ABANS DE LA NO APROVACI\u00d3 DEL DECRET LLEI PEL CONGR\u00c9S.
