Segons aquesta normativa i despr\u00e9s de diverses modificacions jur\u00eddiques, el punt 10 d&#8217;aquesta llei recull que nom\u00e9s amb una persona m\u00e9s gran de 70 anys o amb discapacitat que ho\u00a0demani &#8211; la instal\u00b7laci\u00f3 de rampes d&#8217;acc\u00e9s en aquest cas- ser\u00e0 de construcci\u00f3 obligat\u00f2ria. L&#8217;article estableix exactament el procediment a seguir per tal de complir amb les<strong> normes d&#8217;accessibilitat universal<\/strong> i afavorir la vida de les comunitats.\u00a0L\u2019article 10\u00a0de la Llei de Propietat Horitzontal indica que<em> \u201ctindran car\u00e0cter obligatori i no requeriran d\u2019acord previ de la Junta de propietaris, impliquin o no modificaci\u00f3 del t\u00edtol constitutiu o dels estatuts\u201d<\/em>, les obres que:<\/p>\n<p><em>\u201cSiguin sol\u00b7licitades a inst\u00e0ncies dels propietaris, sempre que les obres a realitzar tinguin com a finalitat garantir els ajusts\u00a0necessaris en mat\u00e8ria d\u2019accessibilitat universal, entre les que es troba la construcci\u00f3 d\u2019una rampa d\u2019acc\u00e9s al portal d\u2019edifici de la comunitat de ve\u00efns , que \u00e9s l\u2019objecte d\u2019aquest article \u201c.<\/em><\/p>\n<p>Per altra banda, a l&#8217;hora de demanar la instal\u00b7laci\u00f3 d&#8217;un ascensor, despr\u00e9s de la reforma de 2013 s&#8217;ha canviat el <em>quorum<\/em> necessari de 3\/5 propietaris que representin tamb\u00e9 les 3\/5 parts de les quotes de participaci\u00f3 a majoria simple dels propietaris que representin la majoria de les quotes.\u00a0L&#8217;article 17.2 Llei de Propietat Horitzontal ho recull aix\u00ed<em> &#8220;&#8230; Sense perjudici del que estableix l&#8217;article 10.1 b), la realitzaci\u00f3 d&#8217;obres o l&#8217;establiment de nous serveis comuns que tinguin per finalitat la supressi\u00f3 de barreres arquitect\u00f2niques que dificulten l&#8217;acc\u00e9s o mobilitat de persones amb discapacitat i, en tot cas, l&#8217;establiment dels serveis d&#8217;ascensor, fins i tot quan impliquin la modificaci\u00f3 del t\u00edtol constitutiu, o dels estatuts, requereix el vot favorable de la majoria dels propietaris, que, al seu torn , representin la majoria de les quotes de participaci\u00f3 &#8230; &#8220;<\/em><\/p>\n<h3><strong>I, qui\u00a0se&#8217;n fa c\u00e0rrec?<\/strong><\/h3>\n<p>La contribuci\u00f3 \u00e9s obligat\u00f2ria per part de tots els propietaris, tal i com ho diu l&#8217;article 10.1.b) de la Llei de Propietat Horitzontal\u00a0<em>&#8220;&#8230; 1. Tindran car\u00e0cter obligatori i no requeriran d&#8217;acord previ de la Junta de propietaris, impliquin o no modificaci\u00f3 del t\u00edtol constitutiu o dels estatuts, i vinguin imposades per les administracions p\u00fabliques o sol\u00b7licitades a inst\u00e0ncia dels propietaris, les seg\u00fcents actuacions (&#8230;)<\/em><\/p>\n<p><em>(&#8230;) b) Les obres i actuacions que resultin necess\u00e0ries per a garantir els ajustaments raonables en mat\u00e8ria d&#8217;accessibilitat universal i, en tot cas, les requerides a inst\u00e0ncia dels propietaris en l&#8217;habitatge o local visquin, treballin o prestin serveis voluntaris, persones amb discapacitat, o majors de setanta anys, amb l&#8217;objecte d&#8217;assegurar-los un \u00fas adequat a les seves necessitats dels elements comuns, aix\u00ed com la <strong>instal\u00b7laci\u00f3 de rampes, ascensors o altres dispositius mec\u00e0nics i electr\u00f2nics que afavoreixin l&#8217;orientaci\u00f3 o la seva comunicaci\u00f3 amb l&#8217;exterior<\/strong>, sempre que l&#8217;import repercutit anualment de les mateixes, un cop descomptades les subvencions o ajudes p\u00fabliques, no excedeixi de dotze mensualitats ordin\u00e0ries de despeses comunes. No eliminar\u00e0 el car\u00e0cter obligatori d&#8217;aquestes obres el fet que la resta del seu cost, m\u00e9s enll\u00e0 de les esmentades mensualitats, sigui assumit pels qui les hagin requerit (&#8230;).<\/em><\/p>\n<p>Tot i aix\u00ed, cada propietari pagar\u00e0 en funci\u00f3 de la quota o coeficient del seu habitatge. No pagaran m\u00e9s els ve\u00efns d&#8217;habitatges en plantes superiors enfront dels de plantes inferiors. Tots contribuiran en funci\u00f3 del coeficient que aparegui reflectit en l&#8217;escriptura de propietat de l&#8217;habitatge o local.<\/p>\n<p>Aix\u00ed doncs, la instal\u00b7laci\u00f3 de rampa o ascensor \u00e9s un dret i una obligaci\u00f3 per part de la comunitat.
