{"id":2709,"date":"2017-02-27T15:37:16","date_gmt":"2017-02-27T15:37:16","guid":{"rendered":"https:\/\/amat-inmo-wp.localhost\/2017\/02\/27\/cal-pagar-plusvalua-municipal\/"},"modified":"2026-05-07T16:20:52","modified_gmt":"2026-05-07T16:20:52","slug":"cal-pagar-plusvalua-municipal","status":"publish","type":"post","link":"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2017\/02\/cal-pagar-plusvalua-municipal\/","title":{"rendered":"Cal, realment, pagar la plusv\u00e0lua municipal?"},"content":{"rendered":"<p style=\"text-align: justify;\">Haureu sentit a parlar de la <strong>sent\u00e8ncia del Tribunal constitucional sobre la plusv\u00e0lua municipal<\/strong>, que molta gent s\u2019apunta per dir que ja no cal pagar-la.<\/p>\n<p style=\"text-align: justify;\">La<strong> plusv\u00e0lua municipal,<\/strong> que no els increments de patrimoni que hauran de tributar a l\u2019impost de la renda si \u00e9s el cas, \u00e9s un impost que es paga segons uns c\u00e0lculs autom\u00e0tics en funci\u00f3 del que estableixin les ordenances fiscals municipals.<\/p>\n<p style=\"text-align: justify;\">Si b\u00e9 hi ha un marc com\u00fa &#8211; que es la Ley de Bases del R\u00e9gimen Local-, cada ajuntament decideix els percentatges d\u2019increment de valor i el tipus de gravamen:<\/p>\n<p style=\"text-align: justify;\"><strong>\u00bfCom es calcula?<\/strong><\/p>\n<p style=\"text-align: justify;\">S\u2019agafa el valor del s\u00f2l (actual, el que \u00e9s incomprensible) i es multiplica pel percentatge de l\u2019increment del valor (que canvia segons els ajuntaments i els anys) pels anys que l\u2019han tingut, el que d\u00f3na una base que s\u2019ha de multiplicar per un tipus impositiu, que diu la llei de bases que ser\u00e0 com a m\u00e0xim del 30%.<\/p>\n<p style=\"text-align: justify;\">\u00c9s per aix\u00f2 que la simple propietat d&#8217;un terreny durant un determinat per\u00edode temporal produeix, en tot cas i de forma autom\u00e0tica, un increment del seu valor.<\/p>\n<p style=\"text-align: justify;\">Mirem un comparatiu entre diferents pobles per un mateix valor cadastral i els mateixos anys.<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-7579 \" src=\"https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/01\/taules-blog.jpg\" width=\"442\" height=\"515\" \/><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><strong>L&#8217;augment del valor del s\u00f2l es determina mitjan\u00e7ant l&#8217;aplicaci\u00f3 autom\u00e0tica dels coeficients que preveu la norma al valor cadastral del s\u00f2l en el moment de la transmissi\u00f3.<\/strong> La mera propietat d&#8217;un terreny durant un determinat per\u00edode temporal produeix, en tot cas i de forma autom\u00e0tica, un increment del seu valor.<\/p>\n<p style=\"text-align: justify;\">La Sent\u00e8ncia del TC de 16 de febrer del 2017 diu que no \u00e9s legal imposar un impost quan no s&#8217;ha produ\u00eft un guany econ\u00f2mic.<\/p>\n<p style=\"text-align: justify;\">El constitucional resol la q\u00fcesti\u00f3 d\u2019inconstitucionalitat n\u00fam. 1012-2015 promoguda pel\u00a0 Jutjat de lo Contenci\u00f3s -Administratiu n\u00fam. 3 de Donostia, per possible infracci\u00f3 tant del principi de capacitat econ\u00f2mica i de la prohibici\u00f3 de confiscatorietat (art. 31 CE), com del dret de defensa (art. 24 CE), decidint:<\/p>\n<ul>\n<li>\u00a0Inadmetre la q\u00fcesti\u00f3 d\u2019inconstitucionalitat respecte als arts 107 i 110. 4 del Real Decreto Legislativo 2\/2004, de 5 de marzo, pel que s\u2019aprova el text ref\u00f3s de la Ley reguladora de las Haciendas Locales.<\/li>\n<li>Q\u00fcestionava aquests articles per possible violaci\u00f3 dels principis constitucionals de capacitat econ\u00f2mica i de no confiscatorietat, perqu\u00e8 o es sotmet la tributaci\u00f3 a una plusv\u00e0lua real sin\u00f3 quantificada de forma objectiva, sense que els increments siguin certs i sense permetre prova en contra que desvirtu\u00ef la plusv\u00e0lua fict\u00edcia imputada, per venir calculat de forma predeterminada amb una clara limitaci\u00f3 del dret de defensa.<\/li>\n<li>\u00a0Declarar inconstitucionals i\u00a0 nuls els arts 4.1, 4.2 a) y 7.4, de la Norma Foral 16\/1989, de 5 de julio, del Impuesto sobre el Incremento del Valor de los Terrenos de Naturaleza Urbana del Territorio Hist\u00f3rico de Gipuzkoa, per\u00f2 \u00fanicament en la mesura que sotmeten a tributaci\u00f3 situacions d\u2019inexist\u00e8ncia d\u2019increments de valor.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>Decideix que la forma de determinar si hi ha un increment que ha de tributar o no correspon al legislador que ha de fer les modificacions al regim legal per evitar que es sotmetin a tributaci\u00f3 situacions amb inexist\u00e8ncia d\u2019increment de valor, pel que haurem d\u2019esperar que es canvi\u00ef la llei per evitar que\u00a0 situacions injustes, com les que es venen donant, es reprodueixin.<\/strong><\/p>\n<p style=\"text-align: right;\"><em>Departament Jur\u00eddic<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Haureu sentit a parlar de la sent\u00e8ncia del Tribunal constitucional sobre la plusv\u00e0lua municipal, que molta gent s\u2019apunta per dir que ja no cal pagar-la.
