En les not\u00edcies immobili\u00e0ries hem recollit alguns dels detalls sobre aix\u00f2.<\/p>\n<p>Qu\u00e8 diu la Llei?<br \/>\nSi has venut el teu pis de Barcelona, recorda que no acaba el reguitzell de gestions que comporta aquesta operaci\u00f3. Una de les obligacions, com d\u00e8iem, \u00e9s que el venedor ha de notificar a la comunitat de propietaris la venda del pis. I \u00e9s que, en el cas que no ho fes, es podria veure en la desagradable situaci\u00f3 de respondre pels deutes contrets pel nou propietari amb la Comunitat<br \/>\nAix\u00ed ho diu la Llei de Propietat Horitzontal a l&#8217;article 9.1 i), en qu\u00e8 estableix que si el venedor no fa aquesta notificaci\u00f3, es veur\u00e0 obligat al pagament solidari dels deutes amb la Comunitat que contregui el nou adquirent del pis o local.<\/p>\n<p>Per assegurar-se que es troba al marge i totalment deslligat dels futurs deutes que contregui el nou titular amb la comunitat de propietaris, pr\u00e8viament s&#8217;ha de comunicar la venda del pis al secretari de la comunitat. Si no n&#8217;hi ha, si no n&#8217;hi ha al president o administrador.<\/p>\n<p>Procediment de notificaci\u00f3<br \/>\nLa comunicaci\u00f3 a la comunitat de la venda del pis\u00a0haur\u00e0 de fer-se per qualsevol mitj\u00e0 del que es deixi const\u00e0ncia, no exigint la Llei que sigui de manera fefaent,\u00a0per la qual cosa un simple escrit dirigit al Secretari de la Comunitat expressant la venda del pis o local , aix\u00ed com les dades del nou propietari ser\u00e0 suficient per complir amb aquesta obligaci\u00f3.<\/p>\n<p>El venedor s&#8217;ha de quedar amb una c\u00f2pia de l&#8217;escrit signada pel secretari de la comunitat on consti la recepci\u00f3. Tamb\u00e9 podeu enviar un burofax o un telegrama.<\/p>\n<p>Si no es pot notificar la venda al Secretari de la Comunitat, se li pot enviar la notificaci\u00f3 a qualsevol altre c\u00e0rrec de representaci\u00f3 de la Comunitat de propietaris. La q\u00fcesti\u00f3 \u00e9s deixar const\u00e0ncia als \u00f2rgans de govern de la Comunitat que l&#8217;immoble ha canviat de mans i donar el nom del nou titular.<\/p>\n<p>Exemple de comunicaci\u00f3<br \/>\nAquest podria ser un escrit dirigit al Secretari de la Comunitat informant de la venda dun pis:<\/p>\n<p>Complint el que disposa l&#8217;article 9.1 regla i) de la Llei de Propietat Horitzontal, li faig constar que amb data xxxx he venut el pis (o local) xxxxxxx, de la Comunitat de propietaris del qual ets el secretari.<\/p>\n<p>El nou titular \u00e9s la Sra. xxxxxxxxx, qui segurament es posar\u00e0 en contacte amb vosaltres. En tot cas, aquesta notificaci\u00f3 serveix per deixar const\u00e0ncia a la Comunitat de propietaris, que haur\u00e0 de prendre les mesures oportunes als efectes de drets i obligacions en relaci\u00f3 amb aquesta propietat, ja que el propietari actual \u00e9s la persona indicada.<\/p>\n<p>Com veus \u00e9s un tr\u00e0mit senzill, l&#8217;execuci\u00f3 del qual pot donar-te una gran tranquil\u00b7litat i estalviar-te m\u00e9s d&#8217;un disgust.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Potser desconeixies l&#8217;obligaci\u00f3 de notificar a la Comunitat de Propietaris la venda del teu habitatge.
