Per exemple, poden saber que s\u00f3n deutors d&#8217;un cr\u00e8dit que pot originar un embargament preventiu en el Registre.<\/p>\n<p>En aquest sup\u00f2sits, els venedors tenen l&#8217;obligaci\u00f3 tant moral i jur\u00eddica d&#8217;informar de la situaci\u00f3 real de c\u00e0rregues de la finca i, si no ho fan, es poden veure obligats a retornar les arres duplicades o b\u00e9 ser demandats per danys i perjudicis, ja que la falta d&#8217;informaci\u00f3 ha produ\u00eft que el comprador es trob\u00e9s en una situaci\u00f3 d&#8217;inseguretat jur\u00eddica.<\/p>\n<p>Per aquest motiu, ratifiquem el que ja hem dit en altres ocasions: \u00e9s necessari demanar la <strong>nota registral<\/strong> de les finques que es posen en venda en el mateix moment en qu\u00e8 es d\u00f3na l&#8217;autoritzaci\u00f3 de comercialitzaci\u00f3, tornar-la a demanar en el moment de subscriure les arres i de nou en el moment de l&#8217;atorgament de l&#8217;escriptura de compravenda, ja que les c\u00e0rregues poden ser diferents en cada un d&#8217;aquests tres moments.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Els venedors tenen l&#8217;obligaci\u00f3 d&#8217;informar no solament de les c\u00e0rregues que ja figuren inscrites en el Registre de Propietat, sin\u00f3 tamb\u00e9 de les que saben que existeixen i a les quals poden accedir en el Registre, malgrat que no hi figurin en el moment de l&#8217;atorgament de les arres.
