Jose Vicente Gald\u00f3n, per tractar dos temes fiscals d\u2019absoluta actualitat.<\/p>\n<p>Els temes en q\u00fcesti\u00f3 versaven sobre el nou concepte jur\u00eddic que afecta, en primera inst\u00e0ncia, a les transmissions, tan oneroses com lucratives, com \u00e9s el valor de refer\u00e8ncia cadastral i en segon lloc, per\u00f2 no menys important, l\u2019impost de plusv\u00e0lua municipal i els efectes de la darrera sentencia del tribunal constitucional.<\/p>\n<h4><strong><u>Valor de refer\u00e8ncia cadastral<\/u><\/strong><\/h4>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-18106 alignright\" src=\"https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/03\/photo-by-scott-graham-1024x684-1.jpg\" alt=\"\" width=\"265\" height=\"177\" srcset=\"https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/03\/photo-by-scott-graham-1024x684-1.jpg 1024w, https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/03\/photo-by-scott-graham-1024x684-1-300x200.jpg 300w, https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/03\/photo-by-scott-graham-1024x684-1-768x513.jpg 768w\" sizes=\"(max-width: 265px) 100vw, 265px\" \/>Com d\u00e8iem, el valor de refer\u00e8ncia cadastral, \u00e9s un <strong>nou concepte jur\u00eddic vigent des de l\u20191 de gener de 2022<\/strong> i ve determinat, any a any, per la Direcci\u00f3 General del Cadastre com a resultat dels an\u00e0lisi de preus mitjos de les operacions realitzades davant notari segons \u00e0mbits territorials homogenis. Aquest valor de refer\u00e8ncia, que no pot ser superior al valor de mercat, passa a ser la <strong>nova base imposable de l\u2019Impost sobre Transmissions i Actes Jur\u00eddics Documentats i l\u2019Impost sobre Successions i Donacions<\/strong>, si aquest \u00e9s superior al valor declarat en escriptura pels contribuents. Aix\u00ed mateix, cal posar de manifest que aquest valor de refer\u00e8ncia tamb\u00e9 pot tenir implicacions en l\u2019\u00e0mbit de l\u2019Impost sobre el Patrimoni (nom\u00e9s per les adquisicions efectuades a partir de l\u20191 de gener del 2022). Aix\u00f2 \u00e9s aix\u00ed donat que la normativa d\u2019aquest impost estableix que el valor dels immobles a declarar en aquest impost \u00e9s el valor major de: valor cadastral; valor adquisici\u00f3; o valor comprovat per l\u2019administraci\u00f3 (essent aquest \u00faltim, el valor de refer\u00e8ncia cadastral).<\/p>\n<p>Tot i que previsiblement el valor de refer\u00e8ncia no havia de ser superior al valor de mercat, la realitat est\u00e0 demostrant que no est\u00e0 essent aix\u00ed en molts casos, i aix\u00f2 implica, en primer lloc, que s\u2019estan gravant rendes fict\u00edcies, i en segon lloc, que s\u2019est\u00e0 produint un increment important d\u2019impostos. I qu\u00e8 podem fer si no estem d\u2019acord amb el valor de refer\u00e8ncia? Doncs hi ha <strong>dues alternatives<\/strong>, que seran nom\u00e9s possibles quan tingui lloc una transmissi\u00f3, no abans.<\/p>\n<ul>\n<li>Per una banda, es pot presentar i pagar l\u2019impost i posteriorment sol\u00b7licitar la rectificaci\u00f3 de l\u2019autoliquidaci\u00f3 presentada.<\/li>\n<li>Per altra banda, declarar i pagar en base al que s\u2019ha escripturat (inferior en aquest cas al valor de refer\u00e8ncia) i esperar a rebre la complement\u00e0ria per part de l\u2019Ag\u00e8ncia Tribut\u00e0ria i en aquell moment interposar el corresponent recurs.<\/li>\n<\/ul>\n<p>Tot i aix\u00ed, som de l\u2019opini\u00f3 que la primera opci\u00f3 \u00e9s m\u00e9s beneficiosa ja que la segona implica inc\u00f3rrer en una infracci\u00f3 tributaria que comporta conseq\u00fcentment la imposici\u00f3 d\u2019una sanci\u00f3.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-18103 alignleft\" src=\"https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/03\/photo-by-dimitri-karastelev-300x200-1.jpg\" alt=\"\" width=\"246\" height=\"164\" \/>Cal destacar per\u00f2, que impugnar el valor de refer\u00e8ncia implica una s\u00e8rie de despeses en quant a taxaci\u00f3 pericial, aixecament d\u2019acta notarial amb fotografies, etc. per demostrar que el valor declarat en escriptura \u00e9s el correcte. Per tant, a difer\u00e8ncia d\u2019abans, ara \u00e9s el contribuent qui t\u00e9 la c\u00e0rrega de la prova, qui ha de demostrar el valor.<\/p>\n<p>Per \u00faltim, no s\u2019han d\u2019oblidar els <strong>efectes del valor de refer\u00e8ncia en el possible guany patrimonial en l\u2019IRPF i en la plusv\u00e0lua municipal del venedor<\/strong>. En aquest sentit, si estem davant d\u2019una transmissi\u00f3 onerosa, el valor de refer\u00e8ncia no tindr\u00e0 cap impacte en el venedor. Tanmateix, si estem davant d\u2019una transmissi\u00f3 lucrativa on el valor escripturat \u00e9s inferior al valor de refer\u00e8ncia, es prendr\u00e0 aquest \u00faltim a efectes de calcular el guany patrimonial en l\u2019IRPF i en la plusv\u00e0lua municipal.<\/p>\n<p>En definitiva, aquest nou concepte jur\u00eddic ha entrat per la porta del darrere per quedar-se, sembla ser, a llarg termini. Tot i aix\u00ed, diverses veus apunten a una possible inconstitucionalitat del mateix, pel fet de gravar rendes fict\u00edcies que atempten contra el principi de capacitat econ\u00f2mica. Ara resta esperar en quin sentit es pronuncien els tribunals.<\/p>\n<h4><strong><u>Impost de plusv\u00e0lua municipal<\/u><\/strong><\/h4>\n<p>No menys important \u00e9s la sent\u00e8ncia del Tribunal Constitucional del 26 d\u2019octubre del 2021 i els canvis que ha comportat en la <strong>nova configuraci\u00f3 de la<\/strong> <strong>plusv\u00e0lua municipal<\/strong>. En aquest sentit, la mencionada sent\u00e8ncia declara inconstitucional el sistema de c\u00e0lcul de la base imposable existent de l\u2019impost, al no respondre a la realitat del mercat immobiliari i vulnerar el principi de capacitat econ\u00f2mica del contribuent. La seva publicaci\u00f3 produeix la nul\u00b7litat total de l\u2019impost que ha estat vigent fins la publicaci\u00f3 del Real Decret Legislatiu 26\/2021, que va entrar en vigor el 10 de novembre de 2021. Per tant, <strong>entre el 26 d\u2019octubre i el 10 de novembre de 2021 hi ha un buit legal al respecte de la plusv\u00e0lua municipal pel qual, les operacions efectuades en aquest termini no estan subjectes al citat impost.<\/strong><\/p>\n<p>La nova normativa de la plusv\u00e0lua municipal contempla dos aspectes de gran rellev\u00e0ncia: per una banda, <strong>si no hi ha hagut un increment de valor, no hi ha tributaci\u00f3 <\/strong>per aquest impost. Per altra banda, en el cas que s\u00ed hi hagi increment de valor, s\u2019estableix dos sistemes de determinaci\u00f3 de la base imposable:<\/p>\n<ul>\n<li>El sistema objectiu establert fins ara (basat en el n\u00famero d\u2019anys que ha estat en el patrimoni del venedor).<\/li>\n<li>El <strong>nou sistema subjectiu que t\u00e9 en compte la plusv\u00e0lua real derivada de la transmissi\u00f3<\/strong> (ja que el c\u00e0lcul \u00e9s a partir del valor de transmissi\u00f3 i el valor d\u2019adquisici\u00f3 de l\u2019immoble en q\u00fcesti\u00f3).<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-18100 alignright\" src=\"https:\/\/www.amatimmobiliaris.com\/w\/wp-content\/uploads\/2022\/03\/photo-by-tyler-franta-300x200-1.jpg\" alt=\"\" width=\"247\" height=\"164\" \/>Per \u00faltim, <strong>qu\u00e8 passa amb les liquidacions i autoliquidacions anteriors al 26 d\u2019octubre del 2021 i que la sent\u00e8ncia declara la inconstitucionalitat de l\u2019impost?<\/strong> Doncs cal destacar que no totes s\u00f3n susceptibles de poder rec\u00f3rrer ja que la pr\u00f2pia sent\u00e8ncia s\u2019encarrega d\u2019evitar la retroactivitat de la mateixa en aquells casos en que hi hagi una resoluci\u00f3 judicial o administrativa ferma. Tanmateix en aquells casos en que estigui pendent de liquidaci\u00f3 o autoliquidaci\u00f3, la plusv\u00e0lua municipal no ser\u00e0 exigible, donat que el Real Decret Legislatiu 26\/2021 vigent no t\u00e9 efectes retroactius i la normativa anterior \u00e9s inconstitucional.<\/p>\n<p>En darrer lloc, les autoliquidacions pagades durant els \u00faltims quatre anys, la sent\u00e8ncia considera que \u00e9s una situaci\u00f3 consolidada i que, per tant, no \u00e9s exigible la devoluci\u00f3. Tot i aix\u00ed, podria estudiar-se la possibilitat de rectificar les autoliquidacions dels \u00faltims quatre anys, les quals es pugui al\u00b7legar altres motius com la inexist\u00e8ncia d\u2019increment de valor o si la quota tribut\u00e0ria excedeix el propi increment de valor.
