{"id":13661,"date":"2016-10-20T14:41:11","date_gmt":"2016-10-20T14:41:11","guid":{"rendered":"http:\/\/amat-inmo-wp.localhost\/2016\/10\/20\/exoneracio-retencions-immobles-tenir-compte\/"},"modified":"2023-04-27T14:26:18","modified_gmt":"2023-04-27T14:26:18","slug":"exoneracio-retencions-immobles-tenir-compte","status":"publish","type":"post","link":"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2016\/10\/exoneracio-retencions-immobles-tenir-compte\/","title":{"rendered":"L\u2019exoneraci\u00f3 de retencions als arrendaments d\u2019immobles: una q\u00fcesti\u00f3 a tenir en compte"},"content":{"rendered":"<p style=\"text-align: justify;\">Com ja \u00e9s ben sabut, amb car\u00e0cter general<strong> estan subjectes a retenci\u00f3 als arrendaments o subarrendaments d\u2019immobles urbans<\/strong> per\u00f2, al mateix temps, existeixen alguns sup\u00f2sits <strong>exceptuats de practicar retenci\u00f3<\/strong>, d\u2019acord a l\u2019article 75.3.g del Reglament de l\u2019Impost sobre la Renda de les Persones F\u00edsiques, com s\u00f3n els seg\u00fcents:<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Quan es tracti d\u2019arrendaments d\u2019habitatges per empreses pels seus empleats.<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Quan les rendes satisfetes per l\u2019arrendatari a un mateix arrendador no superin els 900 euros anuals.<\/p>\n<p style=\"text-align: justify;\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Quan l\u2019activitat de l\u2019arrendador estigui classificada en algun dels ep\u00edgrafs del grup del grup 861 de l\u2019IAE o en algun altre ep\u00edgraf que faculti per l\u2019activitat d\u2019arrendament\u00a0 subarrendament de b\u00e9ns immobles urbans i aplicant al valor cadastral dels immobles destinats a l\u2019arrendament o subarrendament les regles per determinar la quota establerta en els ep\u00edgrafs del citat grup 861, no result\u00e9s quota zero.<\/p>\n<p style=\"text-align: justify;\">Ens centrarem en aquest cas en el tercer dels punts donat que \u00e9s el que pot generar m\u00e9s confusi\u00f3.<\/p>\n<p style=\"text-align: justify;\">L\u2019ep\u00edgraf 861 de l\u2019IAE t\u00e9 establerta la seva quota en funci\u00f3 del valor cadastral dels b\u00e9ns immobles afectes a l\u2019activitat determinant-se l\u2019import m\u00ednim de la mateixa aplicant el 0,10% al valor cadastral. Quan la quota, determinada d\u2019aquesta manera, d\u00f3na un valor <strong>inferior a 601,01 euros<\/strong> s\u2019ent\u00e9n que <strong>tributa per quota zero<\/strong>. \u00c9s a dir, <strong>si la suma dels valors cadastrals<\/strong> dels immobles afectes a l\u2019activitat d\u2019arrendament <strong>\u00e9s superior a 601.012,10 euros<\/strong> no es tributa per quota zero i per tant, es pot sol\u00b7licitar el<strong> certificat d\u2019exoneraci\u00f3 de retencions<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Per obtenir aquest certificat s\u2019haur\u00e0 de complimentar el <strong>model 01<\/strong> i presentar-lo, b\u00e9 accedint a la p\u00e0gina web de l\u2019Ag\u00e8ncia Estatal de l\u2019Administraci\u00f3 Tribut\u00e0ria, <a href=\"https:\/\/sede.agenciatributaria.gob.es\/Sede\/procedimientoini\/G325.shtml\">AEAT<\/a>\u00a0 o b\u00e9 presencialment a les oficines de l\u2019AEAT corresponent al domicili fiscal, i adjuntar els justificants dels valors cadastrals dels immobles afectes. Un cop sol\u00b7licitat, l\u2019Administraci\u00f3 Tribut\u00e0ria enviar\u00e0 el certificat que servir\u00e0 com a justificant acreditatiu davant dels arrendataris (l\u2019obligaci\u00f3 d\u2019acreditar aquesta exoneraci\u00f3 \u00e9s de l\u2019arrendador) i a partir d\u2019aquest moment les factures es poden emetre sense retenci\u00f3.
