Els clients &#8211; venedors es pregunten: <strong>Quan hem d&#8217;abonar els honoraris?, en el moment de la signatura de les arres?, en el moment de l&#8217;atorgament de l&#8217;escriptura<\/strong>?<\/p>\n<p style=\"text-align: justify;\">El tema \u00e9s important, i les suspic\u00e0cies son l\u00f2giques, ja que, qui m\u00e9s qui menys, ha tingut una experi\u00e8ncia d&#8217;aquest tipus, o t\u00e9 algun amic o conegut que s&#8217;ha trobat en la desagradable situaci\u00f3 d&#8217;abonar els honoraris en el moment de subscriure les arres, a rengl\u00f3 seguit produir-se <strong>\u201cla desaparici\u00f3 literal de l\u2019intermediari\u201d<\/strong> i a partir d&#8217;aquell moment tenir la necessitat imperiosa de <strong>contractar un advocat<\/strong> perqu\u00e8 vetlli per l&#8217;operaci\u00f3 fins a l\u2019escriptura i com \u00e9s l\u00f2gic, aquestes situacions<strong> creen inseguretat i desconfian\u00e7a.<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00c9s cert que jur\u00eddicament l&#8217;obligaci\u00f3 d&#8217;abonar els honoraris neix en el moment de les arres i aix\u00ed queda clar en una recent sent\u00e8ncia de l&#8217;Audi\u00e8ncia Provincial de Barcelona amb data 25 de maig del 2004, en la qual es determina que si existeix un enc\u00e0rrec de venda, s&#8217;ha trobat un comprador, s&#8217;ha pactat un preu i s&#8217;han signat unes arres penitencials, ha nascut ja el dret a percebre els honoraris, independentment de consumar-se o no, de forma definitiva, la compravenda. Malgrat aquesta sent\u00e8ncia, creiem que la forma m\u00e9s equitativa de resoldre aquest tema per ambdues parts \u00e9s que els honoraris (\u201cla comissi\u00f3\u201d) es cobrin, la meitat en el moment de la signatura de les arres, i l&#8217;altra meitat en el moment de l&#8217;atorgament de l&#8217;escriptura , aix\u00ed el venedor resta m\u00e9s tranquil que vetllarem pels seus interessos fins al final de l\u2019operaci\u00f3.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Aquest \u00e9s un dels punts que suscita m\u00e9s desconfian\u00e7a en la relaci\u00f3 entre els clients- venedors i les empreses que ens dediquem a la intermediaci\u00f3.
