{"id":12286,"date":"2013-07-16T14:46:40","date_gmt":"2013-07-16T14:46:40","guid":{"rendered":"http:\/\/amat-inmo-wp.localhost\/2013\/07\/16\/una-mirada-diferent\/"},"modified":"2023-04-19T15:07:19","modified_gmt":"2023-04-19T15:07:19","slug":"una-mirada-diferent","status":"publish","type":"post","link":"https:\/\/www.amatimmobiliaris.com\/w\/ca\/2013\/07\/una-mirada-diferent\/","title":{"rendered":"Una mirada diferent"},"content":{"rendered":"<p>Hem esperat a fer aquest Diari, per estudiar-nos b\u00e9 les <strong>modificacions a la Llei d\u2019Arrendaments Urbans<\/strong>, pensar quines havien de ser les nostres recomanacions, i organitzar tres actes (un a cada oficina) amb els nostres clients propietaris per explicar les nostres propostes i rebre el seu feedback.<\/p>\n<p>Dit aix\u00f2, podem dir que tenim <strong>una mirada diferent<\/strong>, perqu\u00e8 despr\u00e9s d\u2019escoltar tot el que s\u2019ha dit a les tert\u00falies, el que s\u2019ha escrit als mitjans&#8230; nosaltres opinem molt diferent a la majoria.<\/p>\n<p><strong><em>Ley 4\/2013, de 4 de junio, de medidas de flexibilizaci\u00f3n y fomento del mercado del alquiler de viviendas.\u00a0<\/em><\/strong>Aquest \u00e9s el t\u00edtol de l\u2019\u00faltima modificaci\u00f3 de la <strong>Llei d\u2019Arrendaments Urbans i de la LEC<\/strong>, i ens preguntem: <em>Fomento? <\/em>Parlem de fomento quan al llogater el posem en m\u00e9s incerteses i inseguretats que mai? \u00c9s aix\u00f2 el que conv\u00e9 als propietaris?<\/p>\n<p>Segurament ens ho mirem des del punt de vista d\u2019una part dels arrendadors, des del punt de vista de la tipologia principal dels nostres clients propietaris als que hem intentat inculcar durant anys que el fet de llogar els converteix en empresaris d\u2019un negoci que t\u00e9 com a client als llogaters.<\/p>\n<ul>\n<li><strong>Qu\u00e8 cal fer amb aquest clients\/llogaters?<\/strong> Cuidar-los, garantir la seva seguretat, aconseguir que no t\u2019abandonin.<\/li>\n<li><strong>Quan \u00e9s m\u00e9s rentable el negoci del lloguer?<\/strong> Doncs quan hi ha molt poca rotaci\u00f3, cada vegada que marxa un llogater suposa una despesa per deixar l\u2019habitatge en condicions, i mesos de desocupaci\u00f3 (sense cobrar) fins tornar a tenir l\u2019habitatge llogat.<\/li>\n<\/ul>\n<p>Quan hem escoltat als mitjans, i incl\u00fas hem llegit en comentaris i notes dels col\u00b7legis professionals, que l\u2019opini\u00f3 majorit\u00e0ria \u00e9s pensar que \u00e9s molt bo pels propietaris que puguin fer contractes de tres anys, no ho entenem, ens preguntem:<\/p>\n<ul>\n<li><strong>\u00c9s realment bo pels nostres<\/strong> <strong>clients? <\/strong>La nostra resposta \u00e9s No (salvant sempre situacions especials). Pensem que al contrari, pot traspassar possibles clients llogaters a clients compradors.<\/li>\n<li><strong>\u00c9s bo que poder treure a un llogater tan f\u00e0cilment?<\/strong> La nostra resposta torna a ser No. Es cert que la pr\u00f2pia llei preveu un sistema de protecci\u00f3 a trav\u00e9s de la inscripci\u00f3 del contracte al Registre, per\u00f2, I el seu cost? Quants arrendataris ho faran?<\/li>\n<li><strong>De qu\u00e8 ens serveix un registre \u201cde morosos\u201d si nom\u00e9s s\u2019hi poden inscriure les sent\u00e8ncies fermes? <\/strong>La nostra experi\u00e8ncia, que \u00e9s llarga, \u00e9s que les sentencies que obtenim s\u00f3n m\u00ednimes, en la major part dels casos et deixen les claus dies abans del judici, No s\u00f3n morosos aquests? I els que s\u2019auto-liquiden la fian\u00e7a, No ho s\u00f3n tamb\u00e9?<\/li>\n<\/ul>\n<p>I podr\u00edem continuar&#8230;<\/p>\n<p>Les nostres recomanacions als propietaris s\u00f3n clares: continuar fent contractes de 5 anys, no posar la renuncia a la subrogaci\u00f3 <em>mortis causa<\/em> (aquella que permet que mort el llogater es pugui treure la fam\u00edlia de casa) Quina falta fa si el contracte ja t\u00e9 una durada limitada? Ens sembla excessiu.<\/p>\n<p>El que ens queda clar de la nova <em>Ley de medidas de flexibilizaci\u00f3n y fomento del mercado del alquiler de viviendas<\/em><em>, <\/em>\u00e9s que ara m\u00e9s que mai <strong>el contracte pren<\/strong> <strong>una import\u00e0ncia vital<\/strong>, un bon contracte protegeix les dues parts, i un mal contracte pot portar a situacions mai desitjades, aquest \u00e9s el repte de la flexibilitzaci\u00f3 i la llibertat, ben aplicada \u00e9s perfecte, per\u00f2 s\u2019ha de fer molt b\u00e9.<\/p>\n<p><strong>Desitgem a tothom bones vacances, i que serveixin per \u201ccarregar les piles\u201d.<\/strong><\/p>\n<p>La nostra frase d&#8217;en <strong>Salvador Espriu<\/strong> del mes: <em>Maldem sovint per no fer res, per no deixar de fer res i queixar-nos, perqu\u00e8 no fan res ni ens deixen fer res<\/em>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Hem esperat a fer aquest Diari, per estudiar-nos b\u00e9 les modificacions a la Llei d\u2019Arrendaments Urbans, pensar quines havien de ser les nostres recomanacions, i organitzar tres actes (un a cada oficina) amb els nostres clients propietaris per explicar les nostres propostes i rebre el seu feedback.
