Cal tenir molta prud\u00e8ncia si es vol adquirir una finca on hi ha embargaments. Aix\u00f2 no vol dir que no es pugui transmetre la finca, per\u00f2 si que \u00e9s necessari posar-se en contacte amb cada una de les persones f\u00edsiques o jur\u00eddiques que figuren com a embargants i negociar amb elles la forma en qu\u00e8 es produir\u00e0 la cancel\u00b7laci\u00f3, prestant atenci\u00f3 a concretar exactament, no tan sols el capital pendent, sin\u00f3 tamb\u00e9 els ingressos pendents, interessos de demora, comissions i totes les despeses inherents a l&#8217;aixecament en el Registre d&#8217;aquesta c\u00e0rrega. Cal negociar b\u00e9, ja que en la majoria de les ocasions, el posse\u00efdor de l&#8217;embargament t\u00e9 ganes de liquidar el tema i est\u00e0 en bona disposici\u00f3 per arribar a una entesa. En moltes ocasions, depenent de l&#8217;import i de les possibilitats a subhastar, es pot negociar un &#8220;quitament&#8221;<\/p>\n<p><!--more-->Cal tenir sempre present que si es <strong>compra amb embargaments<\/strong> previs, el comprador se&#8217;n fa c\u00e0rrec dels mateixos. Se subroga en el lloc del deutor.<\/p>\n<p>Per aixecar un embargament del <strong>Registre<\/strong> caldr\u00e0 que l&#8217;advocat de la part creditora presenti al corresponent jutjat i <strong>Registre de la Propietat<\/strong> el manament de cancel\u00b7laci\u00f3 conforme ha estat tot liquidat i no hi ha res pendent de pagament.<\/p>\n<p style=\"text-align: left;\"><strong>Afeccions:<\/strong><\/p>\n<p>Moltes persones se sorprenen en veure una nota al Registre, que al final posa una s\u00e8rie d&#8217;afeccions. Les afeccions no s\u00f3n c\u00e0rregues, s\u00f3n <strong>notes marginals<\/strong>.<\/p>\n<p>La difer\u00e8ncia entre una <strong>c\u00e0rrega<\/strong>, com pot ser una hipoteca o servitud,\u00a0i una nota marginal est\u00e0 en el fet que la c\u00e0rrega \u00e9s real i, per tant, qui adquireix la finca adquireix la c\u00e0rrega, ja que &#8220;s\u00f3n part&#8221; de la finca. Les <strong>afeccions<\/strong>, per contra, s\u00f3n personals i afecten exclusivament al <strong>deutor<\/strong>, no a un tercer.<\/p>\n<p>Cada cop que s&#8217;inscriu al <strong>Registre<\/strong> una venda, una permuta, es genera una afecci\u00f3 i significa que per aquella finca s&#8217;ha presentat els impostos relatius a la transmissi\u00f3 perqu\u00e8 l&#8217;autoliquidaci\u00f3 est\u00e0 subjecte a revisi\u00f3, en el cas de Catalunya per la <strong>Generalitat<\/strong>, 2 anys en el cas de <strong>compra-venda<\/strong> i 4 anys en el cas d&#8217;<strong>her\u00e8ncies<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>No es veuen sovint finques embargades, per\u00f2 tampoc no \u00e9s res estrany.
