Si no es compleix l\u2019obligaci\u00f3, el creditor t\u00e9 dret sobre l\u00b4immoble<br \/>\nper poder cobrar el deute, encara que aquest immoble hagi canviat de\u00a0<strong>propietari<\/strong>.<\/p>\n<p>Aix\u00ed, \u00e9s essencial que la hipoteca existent sigui liquidada per part del venedor pr\u00e8viament a la compravenda i el creditor (normalment entitat banc\u00e0ria) lliuri el certificat de saldo zero.<\/p>\n<p><!--more--><\/p>\n<p>Per\u00f2 hem de saber que una cosa \u00e9s que el\u00a0<strong>venedor<\/strong>\u00a0pagui el seu\u00a0<strong>deute<\/strong>\u00a0(en diem cancel\u00b7laci\u00f3 administrativa) i un altra cosa \u00e9s que aquesta hipoteca sigui cancel\u00b7lada al Registre, (en diem cancel\u00b7laci\u00f3 registral).<\/p>\n<p>Per fer la\u00a0<strong>cancel\u00b7laci\u00f3 registral<\/strong>, es fa l&#8217;<strong>escriptura notarial de cancel\u00b7laci\u00f3<\/strong>\u00a0i el venedor deixa una provisi\u00f3<br \/>\nde fons a qui li tramiti aquesta gesti\u00f3; una vegada realitzada la gesti\u00f3 i cancel\u00b7lada la hipoteca en el\u00a0Registre, la gestoria ha de retornar els diners sobrants, en el seu cas, de la provisi\u00f3.<\/p>\n<p>El que pot passar, i passa massa sovint, \u00e9s que en vendre l&#8217;habitatge es fa la\u00a0<strong>cancel\u00b7laci\u00f3 administrativa<\/strong>\u00a0i es diposita la provisi\u00f3 de fons necess\u00e0ria per fer la cancel\u00b7laci\u00f3 en el Registre, per\u00f2 aquesta no es\u00a0fa o es fa tard&#8230;. El venedor mai no recobra el\u00a0<strong>sobrant de provisi\u00f3 de fons<\/strong>\u00a0i la hipoteca segueix inscrita\u00a0al registre. Aix\u00f2 \u00e9s sempre efecte de mal funcionament de la gestoria que ho ha fet i\/o falta de seguiment de la gesti\u00f3.<\/p>\n<p>Ah!
