En aquests casos, pot un document privat tenir efectes legals?<br \/>\nEt responem&#8230;<\/p>\n<p><strong>Estic interessat en comprar un local i la part venedora que no pot traspassar encara la possessi\u00f3 fins d\u2019aqu\u00ed un any, em proposa atorgar un document privat d&#8217;opci\u00f3 de compra. Aix\u00f3 pot representar-ne algun problema?<\/strong><\/p>\n<p style=\"text-align: left;\">El contracte privat d&#8217;opci\u00f3 de compra \u00e9s perfectament legal i, obliga a les dues parts. Creiem, per\u00f2, que per estar totalment tranquil, caldria la inscripci\u00f3 del contracte en el Registre de la Propietat. I aix\u00f2 per qu\u00e8? Doncs per evitar molts riscos jur\u00eddics i que a continuaci\u00f3 detallem:<\/p>\n<p>1. Si el venedor fos una persona o una societat sense escr\u00fapols, m\u00e9s ben dit , fos estafadora, podria fer la mateixa operaci\u00f3 amb diverses persones a la vegada. Aix\u00f2 havia passat moltes vegades en el passat i malauradament, encara que avui \u00e9s molt infreq\u00fcent, no podem dir que el problema estigui cent per cent eradicat.<\/p>\n<p>2. Podria succeir que en el moment en que es signes l\u00b4opci\u00f3 de compra es comprov\u00e9s que la finca est\u00e0 lliure de carregues, per\u00f2 el que no es pot assegurar \u00e9s que ho estigu\u00e9s en el moment d&#8217;exercir el dret de l\u00b4opci\u00f3 i consumar-se la compravenda.<\/p>\n<p>3. Podria tamb\u00e9 succeir que la part venedora, \u00e9ssent una societat, es declar\u00e9s en suspensi\u00f3 de pagaments o en fallida , amb la qual cosa es podrien perdre tots els drets.
