Doncs s\u00ed, a vegades trobem que es poden fer les coses diferents, tot i que no vol dir que sigui el m\u00e9s recomanable.<br \/>\nPer exemple, avui ens preguntem:<\/p>\n<p><strong>\u00c9s necessari atorgar l&#8217;escriptura de compravenda o b\u00e9 amb el document privat n\u2019hi ha prou?<\/strong><\/p>\n<p style=\"text-align: center;\">\n<p><!--more-->En principi i des d&#8217;un punt de vista jur\u00eddic, el document privat de compravenda t\u00e9 la mateixa validesa que l&#8217;escriptura, per la qual cosa aquest document \u00e9s suficient. Malgrat aix\u00f2, els anys d&#8217;experi\u00e8ncia ens fa <strong>recomanar que s&#8217;atorgui l&#8217;escriptura <\/strong><strong>el m\u00e9s aviat possible<\/strong>.<br \/>\nI per qu\u00e8 aix\u00f2?. Doncs perqu\u00e8 el document privat de compravenda, tot i ser v\u00e0lid a partir del moment en que se signa, si no s&#8217;atorga l&#8217;escriptura i s&#8217;inscriu al Registre de la Propietat, no produeix efectes davant de tercers.<\/p>\n<p>A Amat Immobiliaris , al llarg de la nostra dilatada experi\u00e8ncia professional, ens hem trobat en diverses ocasions amb problemes greus, amb finques que per diferents circumst\u00e0ncies no es van escripturar en el seu moment. Podem posar com a exemples:<\/p>\n<ul>\n<li>Parcel\u00b7les d&#8217;urbanitzacions comprades els <strong>anys setanta i vuitanta<\/strong>, amb documents privats, al cap d\u2019uns anys quan els propietaris han volgut fer l&#8217;escriptura, s\u2019han trobat que la promotora o societat que els va vendre la parcel\u00b7la, ja no existeix o no es localitza. Aix\u00f2 representa un veritable \u201ccalvari\u201d per trobar el fil de la propietat registral.<\/li>\n<\/ul>\n<ul>\n<li>Habitatges dels quals ens han demanat la comercialitzaci\u00f3 per a la venda i en el moment de buscar la nota simple al Registre, com \u00e9s habitual en nosaltres abans de posar-lo en cartera ens hem trobat que o encara est\u00e0 a <strong>nom de l\u2019antic propietari<\/strong> o propiet\u00e0ria, o que havia sortit a subhasta i s&#8217;havia adjudicat. En aquest cas concret el propietari va haver de presentar al jutjat una terceria de domini per fer valer els seus drets.<\/li>\n<\/ul>\n<p>Es poden imaginar l&#8217;esglai del propietari quan v\u00e0rem informar-lo que no era propietari del pis on vivia?
